Resumo
O presente texto pretende estabelecer uma discussão no âmbito da Sociologia e do Direito acerca do
conceito sociológico de dominação masculina, em relação ao conceito jurídico de violência doméstica.
Busca-se com isso delimitar até que ponto os casos de crimes praticados contra mulheres no Brasil, na
primeira década deste século, ainda mantém relação com antigos esquemas de dominação de gênero que
se perpetuaram, mesmo com os avanços institucionais e legais na proteção das mulheres, sem prejuízo
das transformações culturais promovidas pelas lutas sociais de emancipação das mulheres, em especial
pelo movimento feminista. Com isso, procura-se por meio das categorias e referenciais metodológicos
empregados por teóricos como Bourdieu e Foucault, analisar quais discursos possíveis podem ser
encontrados como justificadores da violência contra a mulher ainda nos dias de hoje, além da necessária
crítica social que merece ser formulada acerca de reiterados casos de crimes violentos praticados contra
as mulheres nos dias atuais, manifestando a existência de uma sociedade ainda por demais patriarcal e
autoritária, diante da resistência individual a processos diuturnos de dominação.

Abstract
This current text has a proposal to make a discussion in the sociology and law about the sociological concept
of male dominance in relation to the legal concept of domestic violence. Searching with this delimiting until
when the extent to which cases of crimes against women in Brazil, in the first decade of this century, still
maintains relationship with former schemes gender domination that have been perpetuated, even with
advances, in institutional and legal protection of women, without prejudice to the cultural transformations
promoted by social struggles for the emancipation of women, especially the feminist movement. Therefore,
looking up through the categories and methodological frameworks employed by theorists like Foucault
and Bourdieu, it will be possible analyze discourses which can be found as justifying the violence against
women today, along with the necessary social criticizes that deserves to be formulated about of repeated
cases of violent crimes committed against women in the present day, showing the existence of a society
still too patriarchal and authoritarian, even existing the individual resistance day by day during the processes
of domination.
